What is Really Going on Behind the Scenes in D.C.

President Obama's agenda has been largely thwarted by Congress. But while the President's legislative goals have been blocked, the appointed bureaucrats have been quietly working in ways that can have a direct impact on the investigation and security professions. And while NCISS continues to fight bills that would limit access to information, we are also working to limit what the bureaucrats are attempting to do.

The security industry is concerned about efforts by the National Labor Relations Board to make it easier to form unions by shortening the time employers have to mount a defense against coercive union activities. On the recommendation of legislative advocate Larry Sabbath we have joined major American associations in a coalition to prevent the NLRB from getting its way.

Most alarming are the actions of the Equal Employment Opportunities Commission (EEOC) to rewrite "guidelines" for employers when they want to access credit reports or criminal histories. This summer Legislative Chair Jimmie Mesis provided official comments to the EEOC detailing the value of background checks. And Larry Sabbath is currently working with an ad hoc coalition of major associations, the US Chamber of Commerce, human resource experts and data providers to fight efforts to restrict access to these essential tools. It will be a long and difficult battle because of the ideology of the majority of EEOC commissioners.

The EEOC activity has not garnered much attention in the press. The value of having a Legislative Advocate like Larry is that he has a network of contacts, built up over two decades, who share information with him as issues arise. It's the advantage of having an experienced hand on deck. We need all NCISS members to help provide the resources necessary to retain his services.
